Dear Bargaining Unit Employees,

As many of you are aware, the LIUNA Suffer or Permit Overtime claims process closed on September 30, 2016. The Union & CAIG, in conjunction with the Union’s attorney, are in the process of calculating BUE’s individual settlement proceeds. This grievance includes over 15,000 BUEs who worked in covered positions from 2006-2015. Aside from the thousands of Suffer or Permit Overtime claims submitted, the calculation process includes reviewing hundreds of thousands of Agency payroll records and other data points to determine the individual payments.

This vast amount of data is currently being calculated, verified, and approved. CAIG still plans on beginning to contact eligible BUEs in the coming months to let them know what they are receiving and to start the confirmation process. Please let us know if your contact information changes.

Brothers and Sisters, I am very proud of all of you for standing together throughout this historic FLSA case. I am proud that the Union was able to win the $55 million settlement with IHS, which shows the continued value and necessity of unions. There is simply no way that any individual worker could have achieved such a victory on his/her own. Indeed, without such a joint effort, many of the dedicated and committed public employees who will benefit from this agreement might not even have known that they were entitled to overtime pay that they did not receive. The Laborers’ International Union of North America (LIUNA) stood by you in this fight, and now that we have won, we will work with you to make this settlement process as smooth and efficient as possible. Brothers and sisters, I am awed and inspired by the hard work and persistence of all those who fought to recover the overtime pay many of you were wrongfully denied for many years. The $55-million Settlement Agreement between the Indian Health Service (IHS) and the Laborers’ International Union of North America (LIUNA) was historic in its size and scope. LIUNA has been proud to stand shoulder to shoulder with all of you in this important fight for justice, just as we are deeply proud to represent so many of the dedicated public employees in the IHS.

VICTORY!

LIUNA has won a giant class action grievance which requires IHS to honor the Fair Labor Standards Act (FLSA), a law passed by Congress in 1938 that requires Employers to pay for overtime hours worked. On May 22, 2015, LIUNA General President, Terry O’Sullivan, signed the settlement agreement that creates a Laborers’/ Indian Health Service Justice Fund to pay IHS employees back pay for overtime worked.
